These Terms and Conditions apply to this website, course bookings, payments and participation in TA Academy courses, seminars, briefings, workshops and training programmes.

 

Please read these Terms and Conditions carefully before using this website, making a booking or paying for any TA Academy course or event.

 

By using this website, submitting a booking, registering for a course, paying a deposit, paying an invoice or attending TA Academy training, you agree to these Terms and Conditions.

 

1. Who we are

 

This website is owned and operated by The TA Academy Limited.

 

The TA Academy Limited provides Transactional Analysis training in Aotearoa New Zealand, including foundation, applied and advanced professional training.

In these Terms and Conditions, “TA Academy”, “we”, “us” and “our” refer to The TA Academy Limited.

 

“You”, “participant”, “student” or “delegate” refers to the person using this website, making a booking, paying for a course or attending training.

2. Website use

 

You may use this website to learn about TA Academy, view course information, submit enquiries, join our mailing list, register interest, make bookings and access related training information.

 

You agree not to use this website in a way that is unlawful, misleading, harmful, disruptive or that interferes with the website’s proper operation.

 

We may update, change or remove website content at any time.

 

3. Course information

 

We aim to keep course information, dates, locations, fees, trainers, inclusions and certification details accurate and up to date.

 

However, course details may change where reasonably necessary. This may include changes to course dates, venues, trainers, timetable, course materials, course content or delivery format.

 

If a significant change is required after you have booked, we will contact you as soon as reasonably possible.

 

4. Bookings and acceptance

 

A booking is not confirmed until TA Academy has received the required deposit, full payment or other agreed payment arrangement.

 

Places are subject to availability.

 

TA Academy reserves the right to accept, decline, postpone or cancel a booking where reasonably necessary. This may include situations where:

 

  • a course is full

  • entry requirements have not been met

  • payment has not been received

  • the course is not suitable for the participant

  • there are concerns about participant safety, group safety or the learning environment

  • the participant has previously breached these Terms and Conditions or another TA Academy agreement

 

For some courses, TA Academy may require further information, a conversation, an application process or confirmation of prior training before accepting a booking.

 

5. Entry requirements and course suitability

 

Some courses may have entry requirements or recommended prior learning.

TA Foundations is designed as an accessible starting point and does not require prior Transactional Analysis experience.

 

TA in Practice and the Professional Training Group may require prior TA learning, completion of earlier TA Academy modules or equivalent learning accepted by TA Academy.

 

Participants are responsible for checking that a course is suitable for their needs before booking. If you are unsure, please contact admin@taacademy.nz before booking.

 

TA Academy may ask for information about your training, experience, professional background, supervision arrangements or learning goals where this is relevant to course suitability or progression.

 

6. Fees and payment

 

Course fees are listed in New Zealand dollars and are inclusive of GST unless stated otherwise.

 

Payment may be made through the payment options listed on the website or invoice. These may include bank transfer, card payment, Wix Payments, Afterpay or other approved payment methods.

 

Where a deposit is required, your place is not secured until the deposit has been received.

Where payment by instalments or payment plan is agreed, you remain responsible for paying all amounts by the agreed due dates.

 

If payment is overdue, TA Academy may pause access to training, withhold certificates or decline future enrolment until payment is received.

 

Any bank fees, international transfer fees, card fees or payment provider charges are the participant’s responsibility unless otherwise agreed.

 

7. Deposits

 

Where a deposit is required, the deposit secures your place on the course.

 

Deposits are non-refundable, except where TA Academy cancels the course or where a refund is required by law.

 

8. Administration fee

 

Where an administration fee is referenced in these Terms and Conditions, the fee is $30.

TA Academy may deduct this fee from refunds or charge it for transfers, changes or other administration where stated in these Terms and Conditions.

 

9. Cancellations by participants

 

If you need to cancel your booking, you must notify TA Academy in writing by emailing admin@taacademy.nz.

 

After any applicable cooling off period, participant cancellations are subject to the cancellation terms below.

 

Unless otherwise stated on the course page or agreed in writing:

 

  • cancellations made more than 28 days before the course start date may receive a refund of fees paid, less the non-refundable deposit and any administration fee

  • cancellations made 14 to 28 days before the course start date may be transferred to another course at TA Academy’s discretion, subject to availability and any administration fee

  • cancellations made less than 14 days before the course start date are not eligible for a refund, except where required by law

  • non-attendance, late arrival, partial attendance or withdrawal after the course has started is not eligible for a refund, except where required by law

 

10. Cooling off period

 

A 14 day cooling off period may apply from the date of booking, unless the course begins within that 14 day period.

 

If you cancel within the cooling off period, you may receive a refund of course fees paid, less any non-refundable costs already incurred by TA Academy and any payment processing fees that cannot be recovered.

 

No cooling off refund applies once the course has started or where course materials, pre-course access or digital resources have already been supplied, unless required by law.

 

11. Transfers

 

You may request to transfer your booking to another course date by emailing admin@taacademy.nz.

 

Transfers are subject to availability and TA Academy approval.

Unless otherwise stated:

 

  • transfer requests must be made at least 28 days before the course start date

  • an administration fee may apply

  • any difference in course fees must be paid before the transfer is confirmed

  • only one transfer is permitted per booking unless TA Academy agrees otherwise

 

Transfers requested less than 28 days before the course start date may be declined or approved at TA Academy’s discretion.

 

12. Substitutions

 

If you are unable to attend, you may ask to transfer your place to another suitable person.

Substitutions are subject to TA Academy approval, course suitability, entry requirements and any administration fee.

 

TA Academy may decline a substitution if the proposed participant does not meet the course requirements or if the substitution would affect group safety, course quality or administrative readiness.

 

13. Cancellations or changes by TA Academy

 

TA Academy will make reasonable efforts to run courses as advertised.

 

However, we may need to cancel, postpone, relocate, reschedule or change a course due to circumstances such as low enrolment numbers, trainer illness, venue issues, travel disruption, health and safety concerns or events outside our reasonable control.

 

If TA Academy cancels a course, we will offer either:

 

  • a transfer to another suitable date, where available

  • a credit towards a future TA Academy course

  • a refund of course fees paid

 

If TA Academy postpones or reschedules a course and the new dates do not work for you, we will discuss suitable options with you.

 

TA Academy’s liability for cancellation, postponement or course changes is limited to the course fees paid. We are not responsible for travel, accommodation, loss of income or other costs incurred by participants, unless required by law.

 

Participants should wait until the course has been confirmed before booking non-refundable travel or accommodation.

 

14. Participant responsibilities

 

By booking and attending a TA Academy course, you agree that:

 

  • you will participate respectfully and responsibly

  • you will arrive on time and attend the full course where certification requires full attendance

  • you will communicate with TA Academy as soon as possible if you will be absent or late

  • you will take responsibility for your own learning, wellbeing and participation

  • you will respect the privacy, confidentiality and personal boundaries of other participants

  • you will not record, photograph or share course content or participant contributions without permission

  • you will use course materials and learning within the limits of your own training, qualifications, professional role and ethical obligations

 

15. Personal readiness and wellbeing

 

TA Academy courses may include experiential learning, group discussion, personal reflection, relational learning, somatic exercises, creative exercises and professional practice discussion.

 

Participants are responsible for considering whether they have sufficient emotional and mental resilience to participate safely.

 

Before booking or attending, you must tell TA Academy about any concerns, conditions, limitations or circumstances that may affect your ability to participate fully and safely.

TA Academy may ask for further information where this is relevant to participant safety, group safety or course suitability.

 

TA Academy reserves the right to decline or cancel a booking, request that a participant pauses their training or recommend other support where we reasonably consider this necessary for the participant, group or learning environment.

 

16. Health, disability, cultural, religious or other needs

 

If you have a disability, health need, religious need, cultural need, access requirement, dietary requirement or other special need that may affect your participation, please tell TA Academy at the time of booking or as soon as possible.

 

We will make reasonable efforts to support agreed needs where practical.

 

Where a need cannot reasonably be met due to time, venue, financial, safety or other constraints outside TA Academy’s control, or where insufficient notice has been given, TA Academy may need to decline or postpone attendance.

 

17. Medical information and safety

 

Before or during a course, TA Academy may ask you to provide relevant information about medication, medical conditions, treatment or other matters that could affect your ability to participate fully and safely.

 

You are responsible for seeking your own medical, therapeutic, psychological or professional advice if you are unsure whether a course is suitable for you.

 

TA Academy training is educational and professional development training. It is not a substitute for medical care, therapy, counselling, clinical supervision or emergency support.

 

18. Confidentiality in the training environment

 

TA Academy training may involve personal reflection, professional discussion and group learning.

 

Participants must respect the confidentiality of other participants and must not share personal, identifying or sensitive information disclosed by others in the training environment.

 

This confidentiality expectation does not prevent participants from discussing their own learning in a respectful and non-identifying way.

 

TA Academy trainers may discuss participant progress, suitability, group process or safety matters with relevant TA Academy trainers, supervisors or administrative staff where this is necessary for training, safety, assessment, certification or professional purposes.

Confidentiality may also be limited where disclosure is required by law, professional obligations or serious safety concerns.

 

19. Professional use of course content

 

TA Academy training provides general education and professional development.

Participants are responsible for using any TA Academy learning, skills, materials or concepts within the limits of their own qualifications, professional role, supervision arrangements, insurance, ethical obligations and applicable laws.

 

Unless TA Academy has entered into a separate written supervision agreement with you, TA Academy trainers are not responsible for your professional work with clients, supervisees, students, staff, teams or organisations.

 

Course content is generic and does not constitute specific advice about how to treat, supervise, manage, diagnose or work with any individual client, patient, group, organisation or situation.

 

20. Certification and attendance

 

Certificates may be issued where the course requirements have been met.

Certification may depend on full attendance, participation, completion of required activities, payment of all fees and any other stated course requirements.

 

Attendance certificates confirm attendance only. They do not certify competence, registration, professional membership or authority to practise unless expressly stated.

 

TA Academy may withhold a certificate where a participant has not attended the required hours, has not completed required work, has not paid course fees or has not met course requirements.

 

21. Professional recognition and accreditation pathways

 

TA Academy may provide training that supports wider professional pathways, including Transactional Analysis certification, continuing professional development, coaching credits, counselling pathways or psychotherapy registration pathways.

 

However, acceptance into a course does not guarantee professional registration, membership, certification, accreditation, employment, income, insurance cover or acceptance by any professional body.

 

Participants are responsible for checking the requirements of any professional body, registration board, accrediting body, employer or insurer that applies to them.

 

22. Intellectual property and copyright

 

All course materials, handouts, slides, workbooks, recordings, frameworks, written content, diagrams, website content and other learning materials are protected by copyright and intellectual property rights.

 

Unless otherwise stated, these materials are owned by TA Academy, its trainers or the relevant third-party rights holder.

 

You may use course materials for your own personal learning and professional reference.

You must not copy, reproduce, adapt, distribute, publish, sell, share, upload, teach from or commercially use any course material without prior written permission from TA Academy or the relevant copyright owner.

 

23. Recordings, photographs and course materials

 

Participants must not take photos, audio recordings, video recordings or screenshots of trainers, participants, course materials, slides, group discussions or training activities without prior permission from TA Academy and all people involved.

 

TA Academy may take photos, video, audio recordings or collect testimonials during or after courses, seminars, briefings or training events.

 

If you do not wish to appear in photos, video, audio recordings or testimonials, please tell TA Academy in writing before the course starts.

 

24. Online learning and digital access

 

Where a course, seminar, briefing or part of a programme is delivered online, participants are responsible for having a suitable device, stable internet connection, working camera and microphone where required.

 

Online links and access details are for registered participants only and must not be shared.

TA Academy is not responsible for participant-side technical issues, internet outages or device problems.

 

If TA Academy experiences a significant technical issue that prevents delivery, we will make reasonable efforts to reschedule or provide an alternative.

 

25. Conduct and exclusion

 

TA Academy aims to provide a respectful, safe and professionally serious learning environment.

 

TA Academy may remove, suspend or exclude a participant from a course without refund if, in TA Academy’s reasonable opinion, the participant:

 

  • behaves in a disruptive, unsafe, abusive, discriminatory or inappropriate way

  • breaches confidentiality

  • breaches these Terms and Conditions

  • records or shares course material or participant information without permission

  • fails to follow reasonable trainer instructions

  • creates a risk to themselves, other participants, trainers, staff or the learning environment

 

26. Shared food and personal belongings

 

Any shared food arrangements between participants are undertaken at participants’ own risk.

TA Academy is not responsible for illness, allergic reactions or other issues arising from food brought, shared or consumed by participants unless required by law.

 

Participants are responsible for their own personal belongings while attending training.

 

27. Privacy

 

TA Academy collects and uses personal information in accordance with its Privacy Policy.

By using this website, submitting an enquiry, booking a course or attending training, you acknowledge that TA Academy may collect and use your personal information for course administration, communication, payment, certification, training records and other purposes set out in the Privacy Policy.

28. Complaints and disputes

 

If you have a concern about your booking, payment, course experience or any other matter, please contact TA Academy as soon as possible.

We will make reasonable efforts to respond to concerns in a timely, fair and constructive way.

 

Where possible, we aim to resolve complaints or disputes through direct communication.

If a dispute cannot be resolved through direct communication, it will be handled under New Zealand law. In the event of any unresolved ethical complaints, these can be made to the I.T.A.A. to whose code of conduct all our trainers are bound.

 

29. Consumer rights

 

Nothing in these Terms and Conditions limits or excludes any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other applicable New Zealand law.

 

Where you are acquiring services for business purposes, and it is lawful to do so, the parties agree that the Consumer Guarantees Act 1993 does not apply.

 

30. Limitation of liability

 

To the maximum extent permitted by law, TA Academy is not liable for indirect, consequential or special loss, loss of income, loss of opportunity, travel costs, accommodation costs or other costs arising from your use of this website, booking, cancellation, attendance or reliance on course content.

 

Where TA Academy is liable to you, our liability is limited to the amount you paid for the relevant course or service, except where the law does not allow this limitation.

 

31. No guarantee of outcomes

 

TA Academy takes professional care in preparing and delivering its courses.

However, TA Academy does not guarantee that participation in a course will result in a particular personal, professional, financial, therapeutic, employment, registration or accreditation outcome.

 

Learning outcomes depend on many factors, including participant attendance, engagement, prior experience, personal circumstances, professional context, supervision and any external professional body requirements.

 

32. Events outside our control

 

TA Academy is not responsible for delay, cancellation, non-performance or changes caused by events outside our reasonable control.

 

This may include illness, injury, venue unavailability, travel disruption, severe weather, natural disaster, pandemic, government restrictions, power outage, internet outage, strikes or other events beyond our control.

 

Where this occurs, TA Academy will make reasonable efforts to provide a fair and practical solution, such as rescheduling, transferring, crediting or refunding course fees where appropriate.

33. Changes to these Terms and Conditions

 

TA Academy may update these Terms and Conditions from time to time.

 

The latest version will be published on this website and will apply from the date it is posted.

 

Terms that apply to a confirmed course booking will generally be the terms in place at the time of booking, unless a change is required by law or agreed with you.

 

34. Governing law

 

These Terms and Conditions are governed by the laws of New Zealand.

 

Any disputes relating to these Terms and Conditions, this website or TA Academy courses will be subject to the jurisdiction of the New Zealand courts.
